1. About us

OneTen Technologies is a trading name operated by Jamie Jonas, based in Estepona, Andalucía, Spain. These terms govern your use of the website building, hosting, and related services we provide.

2. Subscription terms

Your subscription includes website hosting, CMS access, and any active add-on services. Invoices are issued monthly and payment is due within 7 days.

If a payment is missed, don't worry — your site will stay live for 7 days while we get things sorted. If the subscription remains inactive after that, we'll take the site offline until payment resumes.

After 60 days without an active subscription, we'll begin winding down your site and removing any stored data in line with EU data protection regulations (GDPR / LOPDGDD).

3. What we provide

Our service includes the design, development, hosting, and ongoing maintenance of your website. Depending on your subscription, this may include:

Website hosting — Your site is hosted on EU-based servers (Hetzner Online GmbH, Germany) and delivered globally via Cloudflare Pages.

CMS access — A dedicated content management system where you can update your site's content, images, and settings.

Monthly update credits — A set number of design or content changes each month, included in your subscription.

Add-on services — Optional features such as blog management, review integrations, analytics, or multilingual support, billed as part of your subscription.

4. Service availability

We aim to keep your website available 24/7. However, like all online services, occasional downtime may occur due to circumstances beyond our control, including but not limited to:

Infrastructure maintenance — Scheduled or emergency maintenance by our hosting providers (Hetzner, Cloudflare).

Third-party outages — Service disruptions at upstream providers, DNS issues, or network-level incidents.

Force majeure — Events beyond reasonable control, including natural disasters, power outages, cyberattacks, or government actions.

We do not guarantee any specific uptime percentage. Where downtime occurs, we will work to restore service as quickly as possible and keep you informed. We are not liable for any losses arising from temporary service unavailability.

5. Your responsibilities

As a subscriber, you agree to:

Provide accurate information — Any business details, content, or materials you supply should be accurate and not infringe on any third-party rights.

Use the service lawfully — Your website must not be used for any unlawful purpose, to distribute harmful content, or to infringe on the rights of others.

Keep credentials secure — You are responsible for maintaining the confidentiality of any login credentials we provide.

Respond in a timely manner — Certain tasks (such as content approvals or domain transfers) may require your input. Delays in responding may affect delivery timelines.

6. Intellectual property

Your content — You retain full ownership of any text, images, logos, or other materials you provide to us. By providing them, you grant us a licence to use them solely for the purpose of building and hosting your website.

Our work — The custom design and code we create for your website is licensed to you for the duration of your active subscription. Upon cancellation, you may request an export of your site's content and media files.

Third-party assets — Stock images, fonts, and open-source libraries used in your site are subject to their respective licences. We will only use assets that permit commercial use.

7. Limitation of liability

To the fullest extent permitted by applicable law:

OneTen Technologies shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from or related to your use of our services.

Our total liability for any claim arising from these terms or our services shall not exceed the total amount you have paid to us in the 3 months preceding the claim.

Nothing in these terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

8. Cancellation and termination

By you — You may cancel your subscription at any time by contacting us at [email protected]. Your site will remain live until the end of the current billing period.

By us — We reserve the right to suspend or terminate your service if you breach these terms, use your site for unlawful purposes, or if your subscription remains unpaid for more than 60 days.

After cancellation — Upon request, we will provide an export of your site content and media files. After 60 days, stored data will be deleted in accordance with our Privacy Policy and applicable data protection regulations.

9. Changes to these terms

We may update these terms from time to time. Any changes will be posted on this page with an updated "Last updated" date. For material changes, we will notify you by email. Continued use of our services after changes take effect constitutes acceptance of the revised terms.

10. Governing law

These terms are governed by and construed in accordance with the laws of Spain. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Estepona, Málaga, Spain.
